(Via Video Conference) [ Mr. Dibyendu Chatterjee .....For the Petitioners CAN 1 of 2020 is disposed of by taking up the writ petition for consideration.

Petitioners claim to be similarly situated and circumstanced as that of the petitioners in W.P. No.14754 (W) of 2018 (Mofikul Alam Molla & Ors. Vs. The State of West Bengal & Ors.). Petitioners claim similar relief. Learned advocate appearing for the Board submits that, the petitioners claim relief with regard to the Teacher Eligibility Test (T.E.T.) of 2014. The earlier writ petition was disposed of by the judgment and order dated April 8, 2019 and that, an appeal with regard thereto is pending. He submits that, the petitioners are not entitled to any relief.

In the facts of the present case, an appeal is pending and since, there is a considerable amount of delay on the part of the petitioners in approaching the Court, at this stage, it would be appropriate to permit the parties to file affidavits. In such circumstances, let affidavit in opposition be filed within one week after reopening, reply, if any, be filed one week thereafter.

List the writ petition under the heading "Hearing" after completion of affidavits.
