The respondents have not filed any affidavit despite directions dated 19th October, 2020 passed by a Co-ordinate Bench of this Court.

The Officer-in-charge, Khejuri Police Station, Purba Medinipur has filed a report dated 15th February, 2023 in the form of instructions addressed to the State Advocate. The same is kept with the record.

It appears from the said report that the disputes between the parties as regards encroachment on the petitioner's land and the construction by the private respondent, is purely civil in nature and cannot be entertained by the Writ Court. The petitioner may take out appropriate civil proceedings, if so advised, in accordance with law.

This Court finds no inaction on the part of the police.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
