CAN 1 of 2020 is disposed of by taking up the writ petition for consideration.

Petitioner complains of unauthorised construction.

Learned Advocate appearing for the municipality submits, on instructions, that, the municipality inspected the locale and found variation of the building rules.

In such circumstances, since the municipality is of the view that, there are variations of the building rules, it will invoke provisions of Section 218 of the West Bengal Municipal Act, 1993 within a period of four weeks from the date of communication of this order. No doubt, the authorities will afford a reasonable opportunity of hearing to the parties in such proceedings. The authorities will pass a reasoned order which the

authorities will communicate to the interested parties forthwith thereafter. It is expected that, the proceedings are disposed of within a period of eight weeks from the date of its commencement.

W.P.A. No.7604 of 2020 is disposed of.

No order as to costs.
