-vsThe State of West Bengal & ors.

Mr. Anujit Mookherji ... for the petitioner Mr. Amitesh Banerjee, ld. Sr. St. Counsel Mr. Tarak Karan ... for the State The petitioner complaint of police inaction.

Learned advocate appearing for the petitioner submits that the private respondent claims to be member of Guardians Forum of a school. The private respondent is instigating and creating disturbance to the normal functioning of the school. He submits that the police are inactive. The petitioner received complaints from both the teaching and non-teaching staff of the school. He submits that the agitation, if any, should be held beyond 200 meters of the school gate.

Learned senior counsel appearing for the State submits that the police are maintaining strict vigil at the locale.

Learned advocate for the private respondent submits that, there are criminal cases pending against the petitioner. The respondent no. 4 is a registered body.

Since there is a complaint of disturbance in the vicinity of a school, it would be appropriate to direct the police authorities to ensure that no breach of peace occurs at the locale. In the event, the respondent no. 4 decide to hold any agitation, the respondent no. 4 may do so upon intimating the police authorities, and maintaining a distance of at least 200 meters from the school gate.
