For the State On prayer of the petitioner liberty is granted to implead the Special Land Acquisition Officer, South 24 Parganas as respondent No. 9 to the writ petition. The cause-title of the writ petition be amended accordingly. The report in the form of affidavit submitted on behalf of the State respondents is taken on record. It appears from the said report that a portion of the land of the petitioner has been utilised by the State respondents for construction of embankment.

No compensation appears to have been paid to the petitioner for the same. The petitioner submitted a representation in this regard before the concerned authority on 3rd September, 2020 which is yet to be considered. The petitioner prays for a direction upon the authority to consider the representation at the earliest.

It is submitted on behalf of the respondents that the 9th respondent be directed to consider the representation, in accordance with law in terms of the report submitted on behalf of the respondents.

In view of the above, the writ petition is disposed of directing the 9th respondent to consider and dispose of the representation submitted by the petitioner dated 3rd September, 2020 within two months from the date of communication of this order upon granting reasonable opportunity of hearing to all the interested persons including the petitioner and in the light of the observation made in the report filed on behalf of the State respondents, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the petitioner is found entitled to compensation, such compensation be disbursed to him within two months thereafter.

The writ petition is thus disposed of.

Consequently CAN 1 of 2020 stands disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
