No. 4627 of 2019 arising out of Berhampore P.S. Case No. 1357 of 2019 dated 29.10.2019 under Sections 498A/302/304B/34 of the Indian Penal Code and under Section 3/ 4 of the DP Act. And In Re : Sujoy Talukder @ Sujoy Talukdar @ Sujay Talukdar ...... petitioner Mr. Kingsuk Mondal .....for the petitioner. Mr. Ranabir Roy Chowdhury ....for the State Petitioner undertakes to affirm and stamp the petition/application as per Rules within 48 hours of resumption of normal functioning of the court. Subject to such undertaking, the application is taken up for hearing through video conferencing.
Learned advocate for the petitioner submits that the petitioner has been implicated in the case and he happens to be husband and the main thrust of the allegations are against the in-laws. Learned advocate for the petitioner further submits that having regard to the fact that charge-sheet has already been submitted, further custodial detention is unwarranted. Mr. Roy Chowdhury, learned Advocate appearing for the State opposes the prayer for anticipatory bail.
deceased ended her life, we are of the opinion that the petitioner may not be extended the privilege of anticipatory bail and as such the prayer for anticipatory bail is rejected. The application being CRM 7285 of 2020 with CRAN 1 of 2020 stand thus disposed of.
