In Re.: CAN 2 of 2021 With CAN 3 of 2021 It appears from the records that in respect of the rival claims between the parties for the property in question, TS No.85 of 2014 is pending and a preliminary decree has also been passed. The said suit is currently pending consideration of interim applications. In that view of the matter, this Court is of the view that the parties may thrash out their differences in the pending civil suit.

There shall be no order in the writ petition and is disposed of.

In view of the above, applications being CAN 2 of 2021 and CAN 3 of 2021 are disposed of.

There shall be no other as to costs.

The report of the OC Usthi Police Station, Diamond Harbour Police District dated 22nd December, 2020 is taken on record.
