State of West Bengal ...opposite party.

The petitioner undertakes to appropriately affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the Court. The petition is taken up on the basis of such undertaking. The petitioner renews his prayer after more than a year, primarily on the ground that the trial is not likely to take place immediately. The petitioner is the husband of the victim. Though the cause title of the petition does not reflect the same, but there is a charge under Section 302 of the Code. The death of the victim was due to manual strangulation. Considering the material against the petitioner cited by the State, the prayer for bail cannot be acceded to. It is hoped that the trial will be taken up as soon as normal functioning of the court resumes.

ar CRM 7340 of 2020 and the interim application therein are disposed of.
