WPA 7679 of 2020 CAN 1 of 2020 Court No. 10 24.11.2020 (Item No. 21) In Re : Ranti Deb Ghosh (SB) (Through Video Conference) Mr. Nilanjan Adhikari ... for the petitioner Mr. Joytosh Majumder Mr. Biswabrata Basu Mallick Ms. Kakali Samajpati .... for the State The petitioner aspired for a post of constable in the West Bengal Police. He participated in a selection process upto the stage of interview. At this stage he has approached this Court alleging that candidates have been called for interview on an arbitrary basis without publication of any merit list as far as the earlier examinations are concerned. He prays for quashing of the entire selection process.

Learned Government Pleader submits that this is essential a service matter which should go to the State Administrative Tribunal (SAT).

I am in agreement with the Government Pleader. In view of Section 3(q) read with Section 15 of the Administrative Tribunal Act 1985, the petitioner should have approached the State Administrative Tribunal.

At this stage the petitioner seeks leave to withdraw this writ petition with liberty to file afresh before the appropriate forum. Such leave is granted. I have not gone into the merits of the matter. All points are left open.

With the above observations, the writ petition being W.P.A. 7679 of 2020 is dismissed as withdrawn. (Arijit Banerjee, J.)
