It is submitted by Ms. Sreyashee Biswas, learned advocate for the petitioner that the petitioner is innocent and he has been falsely implicated in the present case. Ms. Biswas further draws attention of this court to the order passed by a co-ordinate bench in CRM 3178 of 2020 on 12th May, 2020, though the application for bail was rejected but the direction was given by the Hon'ble Court to conclude the trial as
expeditiously as possible on resumption of regular business of the court after lifting of the lockdown preferably by 31st December, 2020.
Mr. Rana Mukherjee, learned advocate for the State opposes the prayer for bail and submits that charge-sheet has already been submitted and trial of the case is expected to commence very shortly. Mr. Mukherjee further contended that FSL report has not yet been received. After receiving the FSL examination report supplementary charge-sheet may be submitted. Considering the submissions as advanced by the learned advocates for the parties and after perusing the injury report, in our considered view, the petitioner's involvement of the offence cannot be ruled out. Accordingly, we are not inclined to grant bail to the petitioner at this stage.
Therefore, the prayer for bail is rejected.
However, we reiterate the direction passed by a co-ordinate bench of the court in CRM 3178 of 2020 on 12th May,2020 thereby directing the learned Judge to conclude the trial as expeditiously as possible on resumption of regular business of the court. Further the learned trial court is directed that after receiving the FSL report the present petitioner's case should be segregated and conclude the same as early as possible as stated above.
The application for bail being C.R.M. 7381 of 2020 and C.R.A.N. 1 of 2020 are disposed of.
