(Through Video Conference) WPA No. 7722 of 2020 Smt. Chaya Das Vs.

CESC Limited and another Mr. Indranil Halder ... for the petitioner.

Mr. Om Narayan Rai, Mr. Ram Mohan Roy ...for the CESC Limited.

Affidavit-in-opposition filed in Court today be kept on record.

However, it appears at the outset that the CESC Limited has taken an objection as to the apprehended splitting of load in the event a new connection is given to the petitioner in terms of the petitioner's application. In such view of the matter, the matter should go before the appropriate authority and the writ court is not the appropriate forum to redress such grievance. Accordingly, WPA 7722 of 2020 is dismissed as not maintainable, with liberty to the petitioner to approach the competent Grievance Redressal Officer (GRO) with the same disputes as raised in this writ petition.

It is made clear that this Court has not gone into the merits of the matter and it will be open to the

competent authorities to decide the matter in accordance with law without being prejudiced in any manner by any of the observations made herein and/or the pleadings made in the instant writ petition. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
