07.08.2023 Item No.20-21 RP Ct. No.1 WPA 6836 of 2020 + IA No.CAN 1 of 2020 CAN 2 of 2020 With WPA 7725 of 2020 Mr. Kishore Mukherjee Mr. Ahitangni Dey ... for Petitioner in WPA 6836 of 2020 Mr. Uday Sankar Chatterjee Mr. Suman Sankar Chatterjee Ms. Trisha Rakshit Ms. Rajashree Tah ... for Petitioner in WPA 7725 of 2020 Mr. S.N. Mukherjee, Ld. AG Mr. T.M. Siddiqui ... for State 1.

The prayer sought for in the public interest litigation was slightly different than the grievance expressed in the Court today. The concern of the writ petitioner was with regard to illegal mining and transportation of sand in the State of West Bengal. Pursuant to the direction issued by this Court a District Level Sand Committee has been constituted as also the State Level Sand Committee and in this regard the learned Advocate General has placed a copy of the Gazette Notification dated 16.05.2023. While it is appreciable that the State level Sand Committee and the District Level Sand Committee have been constituted, it does not stop

with the constitution of the committee but the committee should be fully functional and effectively carry on the purpose for which it was constituted. Therefore, there should be continuous monitoring on mining of sand and its transportation in the State of West Bengal. We hope and trust that the State Level Sand Committee and the District Level Sand Committee shall discharge their duties assigned to them bearing in mind the public interest involved.

2.

With the above observations, the writ petitions and the connected applications are disposed of.

(T. S. SIVAGNANAM) CHIEF JUSTICE (HIRANMAY BHATTACHARYYA, J.)
