Usman Gani @ Osman Goni Mondal v. State Of West Bengal
05.10.2020 Item No.43 Ct.No.11 P.J & S.M C.R.M. 7388 of 2020 (IA No. C.R.A.N 1 of 2020) (Through Video Conference) In Re : An Application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Jalangi P.S. Case No. 102 of 2020 dated 06.03.2020 under Sections 21(C)/29 of NDPS Act.
And In the matter of : Usman Gani @ Osman Goni Mondal ... Petitioner.
Mr. Somnath Adhikary, .... For the petitioner.
Mr. Antariksha Basu, ..... For the State.
Petitioner undertakes to affirm and stamp the petition/application as per Rules within a month of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conferencing.
Learned Counsel for the petitioner submits that the petitioner is an innocent one and he is no way connected in the present case.
He also submits that the petitioner has been falsely implicated on the basis of the statement of the co-accused who has been arrested.
Learned Counsel for the State opposes the prayer for bail and further contends that the involvement of the
petitioner cannot be ruled out and furthermore, the petitioner is absconding. Therefore, the Court should not allow the present application for anticipatory bail. On the submission advanced by the learned Counsel for the parties and after perusing the case diary, we are not inclined to grant anticipatory bail.
Accordingly, the prayer for bail is rejected. The connected application being CRAN 1 of 2020 is accordingly disposed of.
