(31) KC C.R.M. 7392 of 2020 With CRAN 1 of 2020 (Via Video Conference) In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Harirampur Police Station Case No. 49 of 2006 dated 06.08.2006 under Sections 498A/302/304B/120B/379/34 of the Indian Penal Code read with Sections 3/4 of the Dowry Prohibition Act.

The advocate-on-record for the petitioners undertakes to affirm and properly stamp the petition as per the rules within forty eight hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.
This is a fit case for grant of anticipatory bail for the following reasons.
The incident is of 2006. Investigation is complete. Charge-sheet has been submitted against the petitioner. The case is under Section 498A read with Section 304B of the Indian Penal Code. The husband is in custody. The petitioner is the step mother-in-law of the principal accused.
In those circumstances, we allow the application for anticipatory bail.
Subject to the above, in the event of arrest, the petitioner will be released on bail upon furnishing security of Rs. 10,000/- (Rupees Ten Thousand) together with personal release bond of equivalent value to the satisfaction of the arresting officer.
The petitioners will also comply with the conditions laid down in Section 438(2) of the Code.
CRM 7392 of 2020 and the interim application filed therein are disposed of.
