Learned Counsel appearing for the petitioner submits that the respondent no.7 being a private respondent in this writ petition has started construction in a joint property by deviating and altering the sanction plan issued by the concerned authority. Learned Counsel further submits that a representation in this regard has been filed before the administrator, Maheshtala Municipality on 9th September, 2020 but no steps have been taken by the concerned authority till date.

Learned Counsel appearing for the Maheshtala Municipality submits that a stop work notice have already been issued in this regard, to which the learned Counsel appearing for the petitioner submits that construction is in progress till date.

Heard both the parties.

Let the representation dated 9th September,

be considered by the Administrator, Maheshtala Municipality, Kolkata at an earliest preferably within a period of two weeks from date. Before passing any order the Administrator is requested to hear not only the petitioner but also the private respondents in this matter.

The Administrator is also requested to communicate a reasoned order to the petitioner as early as possible preferably within two weeks from the date of taking such decision.

With the above direction WPA 7751 of 2020 is disposed of.

Since no affidavits have been invited, the allegations contained in the writ petition are deemed not to have been admitted by the respondents. There will be no order as to costs.

The parties shall act in terms of the copy of the order downloaded from the official website of this Court.
