Learned Counsel appearing for the petitioner submits that the respondent Kolkata Municipal Corporation is duty bound to give effect and physically carry out the demolition as per direction passed by the respondent no.6 i.e., Special Officer (Building), Kolkata Municipal Corporation. On query from this Court the private respondent submits that no appeal from the demolition order No. D-7/VII/19-20 is preferred till date.

Learned Counsel appearing for the Kolkata Municipal Corporation is present.

Heard all the parties.

The executive engineer (Building), Kolkata Municipal Corporation is requested to consider the demolition order passed in case No.D-7/VII/19-20

and execute the same at an earliest preferably within a period of six weeks from date.

On the prayer made by the learned Counsel appearing for the Kolkata Municipal Corporation the Officer-in-Charge, Beniapukur Police Station is also requested to render necessary assistance to the Executive Engineer (Building), Kolkata Municipal Corporation, if requested by the Executive Engineer. With the above direction WPA 7754 of 2020 is disposed of.

Since no affidavits have been invited, the allegations contained in the writ petition are deemed not to have been admitted by the respondents. There will be no order as to costs.

The parties shall act in terms of the copy of the order downloaded from the official website of this Court.
