In the Matter of : Joydeb Durlav .... petitioner.

Mr. Prabir Majumder ...For the petitioner.

Mr. R. Roychowdhury Mr. Mainak Gupta ...For the State. The advocate-on-record for the petitioner undertakes to affirm and properly stamp the petition as per the rules within forty eight hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

At this stage we are not granting anticipatory bail for the reason that the alleged offence took place on 14th July, 2020 involving large scale theft of FCI foodgrains. Investigation is going on but not completed. This court might reconsider an application for anticipatory bail at an appropriate stage. However, the police may only arrest the petitioner considering all facts strictly according to law.

CRM 7409 of 2020 and the interim application filed therein are disposed of.
