with CRAN 1 of 2020 ASR 09.10.2020 (Via Video Conference) rejected In Re : An application for bail under Section 439 of the Code of Criminal Procedure in connection with G.R. Case no. 833 of 2020 which in turn arose out of Malda Police Station Case no. 118 of 2020 dated 16th February, 2020, thereby alleging the commission of an offence punishable under Section 498A/304B/306/34 of the Indian Penal Code, 1860 and under Section 4 of the Dowry Prohibition Act, 1961 thereby rejecting the petitioner's prayer for bail.

Kutubuddin .......for the State The advocate-on-record for the petitioners undertakes to affirm and properly stamp the petition as per the rules within forty-eight hours of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

The alleged suicide took place on 16th February, 2020. According to learned counsel for the State the husband and the mother-in-law of the victim jointly inflicted unbearable torture on her, as a result of which, she committed suicide.

The husband is in custody.

The mother-in-law is also in custody for 230 days. Charge-sheet has been filed.

Since the mother-in-law is jointly accused with the husband of the victim in a case of alleged grave torture of her daughter-in-law and the husband is in custody, we see no reason to grant bail to the petitioner mother-in-law.

We only expedite the trial with a direction upon the court below to dispose of the case by 30th April, 2021.

CRM 7410 of 2020 with CRAN 1 of 2020 are disposed of.
