Mr. Kushal Chatterjee .... For the Respondent Nos. 10 & 11 Mr. Tanmoy Mukherjee .... For the Respondent No. 9 The grievance of the petitioners is that the authorities of Howrah Municipal Corporation (H.M.C.) has not considered the complaint lodged by the petitioner no. 1 on 14th September, 2020.

Upon hearing the learned advocates for the respective parties and upon considering the materials on record, I am of the opinion that no useful purpose would be served by keeping the writ petition pending and the issue needs to be relegated to the competent authority for consideration.

Accordingly, this Court direct the Respondent No. 5 to consider the representation submitted by the petitioner no. 1 on 14th September, 2020 as annexed

at pages 20 to 22 of the writ petition upon granting an opportunity of hearing to the petitioners and private respondents and to take a decision in accordance with law and to communicate to the said parties. The above exercise shall be completed by the Respondent no. 9 within a period of six weeks from the date of communication of this order along with a copy of this writ petition.

With the above observations and directions the writ petition is disposed of.

As no affidavit has been called for allegations levelled in the writ petition shall be deemed to have been denied by the respondents.
