as per the rules within forty eight hours of resumption of normal functioning of the court. The petitions are taken up through video conference on the basis of such undertaking.
The police report filed in connection with CRM 7341 of 2020 is kept on record.
On the submission of learned advocate for the State that an accused, similarly placed as the petitioner in CRM 7415 of 2020 (Chandan Naskar and Another), has been granted bail, we are minded to allow this application (CRM 7415 of 2020) for bail.
Considering the submission of learned advocate for the State in the application for cancellation of bail {CRM 7341 of 2020 Sujoy Dey vs. State of West Bengal & Ors.)}, we dispose of both the applications by granting bail to the petitioners in CRM 7415 of 2020 with the added condition as mentioned below.
The petitioners in CRM 7415 of 2020 will be released on bail upon furnishing security of Rs.10,000/- (Rupees Ten Thousand) each together with personal release bond of equivalent value to the satisfaction of the appropriate court in South 24 Parganas. The said
petitioners must, however, attend on every date fixed for trial and in the event of failing to do so, the trial court shall be at liberty to cancel the bail of the aforesaid petitioners without any reference to this Court. While disposing of the application for cancellation of bail (CRM 7341 of 2020) we direct that the petitioners in CRM 7415 of 2020 shall be imposed an additional condition that they shall not leave the jurisdiction of the local police station without the permission of the I.C. or the jurisdictional Court.
CRM 7415 of 2020 and CRM 7341 of 2020 and the connected applications therein are disposed of. (I. P. Mukerji, J.) (Md. Nizamuddin, J.)
