The advocate-on-record for the petitioner undertakes to affirm and properly stamp the petition as per the rules within forty-eight hours of resumption of normal functioning of the Court. The petition is taken up through video-conference on the basis of such undertaking.

This is a case under section 302 of the Indian Penal Code. The incident occurred on 16th September, 2019. The petitioner was arrested on 13th October, 2019. He is in custody for 360 days. Charge sheet was submitted on 8th December, 2019. Till date the date charge has not been framed.

There is nothing on record to warrant further detention of the petitioner.

Under those circumstances, we allow this application for bail.

The petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only) together with personal release bond of equivalent value to the satisfaction of the appropriate court, Murshidabad.

The petitioner will cooperate with the investigating officer till the investigation is completed. The petitioner will appear before the concerned trial court on every day fixed for trial and any unexplained absence will entitle the trial court to cancel the bail without reference to this court.
