The petitioner seeks enhancement of her scale of pay as an Assistant Teacher in the concerned School on the basis of increasing her qualification from Honours to Post Graduate Degree in English.

The learned Senior Counsel appearing for the petitioner submits that the request for enhancing her qualification was not responded to by the District Inspector of Schools (SE), Malda. The immediate prayer of the learned Senior Counsel is that a representation made by the petitioner and received by the District Inspector of Schools (SE), Malda on 10th April, 2018 may be considered.

The learned counsel appearing for the State submits that the said representation may be considered by the Commissioner of School Education, being the respondent no.2.

In view of the above, WPA 7778 of 2020 can be disposed of with a direction on the respondent no.2 to consider and decide the representation received by the District Inspector of Schools (SE), Malda on 10th April, 2018 by passing a reasoned order thereon after hearing all the concerned parties. The hearing may also be on the virtual platform.

The respondent no.2 is requested to pass a reasoned order within five weeks from date and a copy of such reasoned order should be communicated to the petitioner within a week thereafter.

The petitioner is directed to forward the representation to the Commissioner of School Education within a week from date.

Since the respondents have not used any affidavit, the statements made in this writ petition are deemed not to have been admitted.
