By an order dated 17th November, 2020, this Court was pleased to record that the record of the application being CRM 7629 of 2020 as placed at the hearing on 17th November, 2020 is incomplete. The reason for so recording emanated from the fact that by an order dated 30th September, 2020 in an identical application qua the self-same parties and numbered as CRM 7440 of 2020, the issue between the parties, as raised in the said application, i.e. CRM 7440 of 2020, was finally disposed of. It is agreed by both Ms. Thard, Learned Advocate for the petitioner and Mr. Roychowdhury, Learned State Advocate led by Learned Public Prosecutor, Mr. Mukhherji, that both CRM 7440 of 2020 and the subsequent present CRM 7629 of 2020 are identical applications although differently numbered due to the exigencies of e-filing procedure adopted during the present virtual mode of hearing.

In the above view of the matter, CRM 7629 of 2020 stands dismissed as infructuous.
