(via Video conference) 43 06.10.2020 CRM 7442 of 2020 Dd/ with CRAN 1 of 2020 In Re - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Nabadwip Police Station case no. 22 of 2020 dated 15.01.2020 under Sections 366/34/376 (2)(n) of the Indian Penal Code and 6 POCSO Act.

In the matter of :Tanmay Banerjee @ Tanay .....Petitioner Mr. Amanul Islam .... for the Petitioner Mr. Binay Panda Ms. Puspita Saha ... For the State The petitioners undertake to affirm and stamp the petition as per the Rules within one month of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking. Accordingly, the application being CRAN 1 of 2020 stand disposed of. Having considered the statement of the victim under Section 164 of the Criminal Procedure Code and the materials available on record against the petitioner, we are of the opinion that the custodial interrogation of the petitioner is not required. Moreover, the charge sheet has already been filed in this case.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Ten thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, 1973.
