Manotosh Biswas v. State Of West Bengal
05. 10 . 2020 CRM 7444 of 2020 With CRAN 1 of 2020 (Via Video Conference) In re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973 in connection with English Bazar Police Station Case No. 380 of dated 04.05.2020 under Sections 498(A)/304B/34 of the Indian Penal Code.
BP/BR Sl.20 In the matter of : Manotosh Biswas...petitioner Mr. A.K. Biswas Mr. J. Hossain ..for the petitioner.
Mr. Partha Pratim Das Ms. Manisha Sharma ..for the State.
Mr. A.K. Biswas, learned advocate for the petitioner submits that nothing reflected from the FIR that the petitioner is involved in the present case. It is further contended that other accused persons have been already granted bail from the co-ordinate bench of this court. Therefore, the petitioner should be released on bail.
Mr. Partha Pratim Das, learned advocate for the State opposes the prayer for bail and submits that it is
evident from the FIR that the deceased was regularly tortured physically for bringing money from her grandfather. The marriage was solemnised in the year 2018. After two years of marriage the wife committed suicide.
Considering the submissions as advanced by the learned advocates for the parties and after perusing the case diary, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail is rejected. The application for bail being C.R.M. 7444 of 2020 and C.R.A.N. 1 of 2020 are disposed of.
