The petitioner/husband filed a matrimonial suit in the court of the Additional District and Sessions Judge, Baruipur, South 24 Parganas in 2018.
Learned Counsel for the petitioner submits that there has been inordinate delay in the conduct of the said suit and by an order dated 19th March, 2020, the matter has how been kept on 1st February, 2021.
On perusing the orders passed by the learned court below, it appears that by an order dated 18th January, 2020, the learned judge noted that there is a chance of reconciliation between the parties and the matter was referred to mediation. The mediation route having failed, there is presently no impediment for the learned court below to hear the suit and resume the process before February, 2021.
In view of the above, C.O. 1260 of 2020 is disposed of with a direction on the learned Additional District and Sessions Judge at Baruipur, South 24 Parganas, to expedite the hearing of the matrimonial suit filed by the
petitioner to the extent possible under the present circumstances caused by the pandemic. The learned judge is requested to fix a date in November, 2020 for hearing the parties in the matrimonial suit and dispose of the same as expeditiously as possible.
