05. 10 . 2020 CRM 7458 of 2020 With CRAN 1 of 2020 (Via Video Conference) In re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhagwangola Police Station Case No. 291 of 2020 dated 23.03.2020 under Sections 498A/304B/34 of the Indian Penal Code.

BP/BR Sl.25 In the matter of : Robiul Islam @ Rabiul...petitioner Mr. A.A. Alamgir Ms. Rabia Khatun Ms. Ria Das ..for the petitioner.

Mr. Prasun Kumar Dutta Mr. Nirupam Dhali ..for the State.

Mr. Alamgir, learned advocate for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. He further submits that the wife consumed poison on 5th May, 2020 at her parental home. Thereafter, on 11th June, 2020 she died and the FIR was lodged on 16th June, 2020. The petitioner is in custody since 30th June, 2020. Therefore, the petitioner should be enlarged on bail.

Learned advocate for the State opposes the prayer for bail and submits that due to torture and demand of dowry the wife was compelled to leave her in-laws house. Thereafter, she consumed poison due to demand of dowry as reflected in the FIR.

Considering the submissions as advanced by the learned advocates for the parties and after perusing the case diary, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail is rejected. The application for bail being C.R.M. 7458 of 2020 and C.R.A.N. 1 of 2020 are disposed of.
