Learned advocate for the petitioner submits that the petitioner is more than 434 days in custody. Though charge-sheet has already been submitted but till date no trial has been commenced. Therefore, the petitioner should be enlarged on bail.

Learned advocate for the State opposes the prayer for bail and submits the case diary and draws our attention to the statement of the eye-witness and also the post mortem report.

Considering the materials available in the case diary, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail is rejected. The application for bail being C.R.M. 7461 of 2020 and C.R.A.N. 1 of 2020 are disposed of.
