C.R.M. 7467 of 2020 With CRAN 1 of 2020 (Via Video conference) In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 in connection Kotwali Police Station Case No. 279 dated May 6, 2020 under Sections 341/323/325/354/307/379/427/506/34 of the Indian Penal Code read with Section 8 of the Protection of Children from Sexual Offences Act.

Bhattacharyya ...for the State The advocate-on-record for the petitioners undertake to affirm and properly stamp the petition as per the rules within forty eight hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

This case does not involve any major injury. An allegation of violation of modesty of a woman is made against the petitioners. The incident took place on 14th February, 2020. No arrest has been made as yet.

In that view of the matter, we allow the application for anticipatory bail of the petitioners.

In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the code of Criminal Procedure, 1973. CRM 7467 of 2020 and the interim application filed therein are disposed of.
