This is an application praying for stay of warrant of arrest issued against the petitioner so that the petitioner can surrender before the learned Trial Court and pray for bail.
Learned Counsel appearing on behalf of the petitioner submits that due to miscommunication with the learned Counsel appearing before the learned Trial Court, the petitioner could not be present before the learned Trial Court and a warrant of arrest was issued. Similarly circumstanced co-accused were granted the privilege of stay of warrant of arrest by this court. The petitioner wants to join the proceeding at the earliest.
Learned Counsel appearing on behalf of the State submits that it will be in the interest of justice that the accused petitioner joined the proceeding at the earliest.
In view of the fact that a similarly circumstanced accused was granted similar benefit and in the interest of justice, I direct that the warrant of arrest against the petitioner shall remain stayed for a period of four weeks from this date. The petitioner is directed to surrender before the learned Trial Court within such time. In the event, the petitioner surrenders before the learned Trial Court within such period of four weeks and prays
for bail, his prayer for bail shall be considered in accordance with law. With these observations, the revisional application is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
