Invocation of provision of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act, 2002) is under challenge in the present writ petition. According to the petitioners, notice under Section 13(2) of the Act of 2002 was not served upon the petitioners.

Learned Advocate appearing on behalf of the petitioners submits that, the petitioners will avail of the opportunity under Section 17 of the Act of 2002.

In such circumstances, W.P.A. 7858 of 2020 is disposed of permitting the petitioners to avail of the statutory alternative remedy in accordance with law.

No order as to costs.
