This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the respondent authority for non-payment of family pension.

I have heard Mr. Supriyo Chattopadhyay, counsel appearing on behalf of the State respondent.

By a letter dated July 7, 2020 the petitioner had been informed that the authority for sanctioning pension is the District Inspector of Schools (S.E.), Paschim Medinipur. It is clear from the facts that petitioner has not approached the District Inspector of Schools. Accordingly, petitioner is directed to approach the District Inspector of Schools (S.E.), Paschim Medinipur and file appropriate application for claim of family pension.

The District Inspector of Schools (S.E.), Paschim Medinipur is directed to look into the said claim and verify

the same from the school authority and proceed in accordance with law.

With these observations, WPA 7873 of 2020 is disposed of.

Since, no affidavit-in-opposition has been called for the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
