SG CRM 7509 of 2020 In Re. An application for bail under Section 439 of the Code of Criminal Procedure in connection with Alipurduar Police Station Case No.380 of 2020 dated 19.08.2020 under Sections 143/188/448 /326/307 and 379 of the Indian Penal Code read with Section 51D D.M. Act, read with Section 3 of E.D. Act.

Mr A. Ghosh ... for the petitioners.

Mr Ujjal Luxom ... for the State.

The petitioners undertake to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking. The petitioners claim to be needlessly detained in a matter involving a minor injury.

The State refers to the case diary. The injury appears to be minor.

Considering the material against the petitioners, their continued detention does not appear to be necessary. The petitioners will be enlarged on bail upon furnishing a security of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, one of whom must be

local, to the satisfaction of the appropriate court in Alipurduar. The petitioners will attend every date fixed for trial and any unexplained absence will entitle the trial court to cancel the bail without reference to this court. CRM 7509 of 2020 is disposed of.
