SG CRM 7510 of 2020 with CRAN 1 of 2020 In Re. An application for bail under Section 439 of the Code of Criminal Procedure in connection with Joypur Police Station Case No.59 of 2019 dated 14.08.2019 under Sections 498A/304B/34 of the Indian Penal Code and 3/4 of D.P. Act.

The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking. The petitioner is the mother-in-law of the victim who apparently committed suicide. The husband has been enlarged on bail by this court.

The petitioner claims not to have done anything improper and says that a husband-wife dispute may have led to the victim taking her life.

The State says that credible allegations of demand for dowry by the mother-in-law and she indulging in acts of torture of the victim shortly after the marriage, have been made.

However, the role of the mother-in-law does not appear to be clear in the unnatural death of the victim which was as a result of possible suicide.

Considering the circumstances, the petitioner is entitled to anticipatory bail.

The petitioner will be enlarged on bail upon furnishing a security of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the appropriate court in Bankura. The petitioner will attend every date fixed for trial and any unexplained absence will entitle the trial court to cancel the bail without reference to this court.
