Mr. Avijit Chakraborty .........for the petitioner Mr. Sk. Md. Galib Mr. Anubrata Santra ...........for the State Learned counsel appearing for the petitioner refers to subsequent facts which are not on record. Counsel submits that the respondents demolished the unauthorized construction on 10th November, 2022 but that the private respondent is constructing a second construction on the same land since the very next day, i.e. 11th November, 2022.

Since the present writ petition is for a direction on the respondent nos. 2 and 3 to demolish the illegal unauthorized construction from the concerned land which is already carried out on 10th November, 2022, nothing further remains to be decided in the present writ petition and the same is accordingly disposed of.

The petitioner shall have liberty of filing a fresh writ petition in respect of the construction which is now going on.

The document dated 12th November, 2022 with regard to the subsequent event is kept on record. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
