Md. Atiur Rahaman v. Union Of India
WPA 7949 of 2020 (VIA VIDEO CONFERENCE) 20.11.2020 KC Md. Atiur Rahaman Vs.
The Union of India & Ors.
Mr. Sarwar Jahan.
... for the petitioner.
Petitioner seeks a direction upon the respondents to delete the name of the ex-wife of the petitioner in the service record of the petitioner as his nominee and replace the nominee by inserting the name of his mother. Learned advocate for the petitioner submits that, the petitioner made a representation to such effect to the authorities. The authorities communicated to the petitioner that the representation will be decided after receipt of communication from the higher authorities. He seeks a direction that the authorities decide the issue expeditiously. None appears for the respondents despite notice. In the facts of the present case, since the petitioner made a representation to the authorities concerned for change of name of the nominee, it would be appropriate to request the authorities to decide such representation, in accordance with law, as expeditiously as possible and
preferably within a period of four weeks from the date of communication of this order. The authorities will afford an opportunity of hearing to the petitioner and the respondents. The authorities are at liberty to hear such other parties and consult such documents that it deems necessary. The authority will communicate its reasoned order to the petitioner forthwith thereafter.
WPA No. 7949 of 2020 is disposed of without any order as to costs.
