The Court is informed that, the petitioner no. 1 died subsequent to the filing of the writ petition. The learned advocates for other petitioners submits, on instructions, that the surviving petitioners may be granted leave to withdraw the writ petition and file afresh on the self-same cause of action.

Learned advocate for the Corporation submits on instructions that, notice under Section 401 of the Kolkata Municipal Corporation Act, 1980 was issued.

Since the surviving petitioners seek leave to withdraw the writ petition and to file afresh on the self-same cause of action, such leave is granted.

WPA No. 7952 of 2020 is disposed of accordingly without any order as to costs.
