The writ petitioner complains that the private respondents are continuously obstructing him and interfering with the peaceful enjoyment of his land. Admittedly, the writ petitioner's father was a Bargadar and the writ petitioner is a Patta holder. There are proceedings pending before the West Bengal Land Reforms and Tenancy Tribunal filed by the writ petitioner. The writ petitioner is aggrieved by the fact that notwithstanding complaints with the Superintendent of Police Baruipur Police District and the Officer-in-Chrage, Kultali Police Station dated 17th July 2020 the private respondents continue to obstruct him and harass him. Learned counsel for the State has produced a report in the form of instructions dated 20th November 2020 issued by the SI, Kultali Police Station, Baruipur PD addressed to the learned Government Pleader and the same is taken on record.

It is submitted that proceedings under Section 107 of the Cr.P.C. have been drawn up on the complaint filed by the writ petitioner.

In that view of the matter, since the issue is otherwise subjudice before the learned West Bengal Land Reforms and Tenancy Tribunal, the Officer-in-Charge, Kultali Police Station shall ensure that there is absolutely no breach of peace in that area. A strict vigil should be maintained by the Kultali Police Station in the locale and any complaint from the parties regarding breach of peace shall be forthwith addressed.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
