No. 16 with CRAN 1 of 2020 In Re - An application for bail under Section 439 of the Code of Criminal Procedure filed on 28.09.2020 in connection with Kaliachak Police Station case no.483 of 2015 dated 03.09.2015 under Sections 341/326/307/302/201/379/34 of the Indian Penal Code.

Dutta ... ...For the State The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner appears to have been absconding for nearly four years and within eight months of his arrest, comes running to seek bail.

The State says that the other accused have been enlarged on bail and the matter could not be taken up because this petitioner was absconding.

Since this petitioner has proved to be slippery, he cannot be shown any latitude in this matter. It is hoped that the trial in the matter is taken up as expeditiously as possible after normal functioning of Court resumes. The prayer for bail is rejected at this stage.

C.R.M. 7589 of 2020 and C.R.A.N. 1 of 2020 are disposed of.
