Inter And Intra Region Bus Association v. C.E.S.C. Ltd
36 (D/L) 22-07-2021 Ct. No.08 debajyoti/BR (Through Video Conference) WPA 8025 of 2020 Inter & Intra Region Bus Association Vs.
CESC Limited & Ors.
Mr. Kishore Mukherjee ... For the Petitioner.
Ms. Smita Das De, Dr. Madhusudan Saha Roy ... For the CESC.
Mr. Santanu Chatterjee ... For the HMC.
Petitioner seeks new electricity connection.
Learned advocate, appearing for the Licensing Company, submits that there is a High-Tension electric supply at the bus stand where the petitioner occupies one room. There are dues in excess of Rs.24,00,000/- from the High Tension supply. A Low-Tension supply cannot be granted.
Learned advocate, appearing for the petitioner, submits that the unit of electricity is around of seven rupees while Kolkata Metropolitan Development Authority ('KMDA' for short), which is taking the High Tension supply, is charging about eleven rupees from the petitioner. He submits that the petitioner is being prejudiced.
In the writ petition, the petitioner seeks new electricity connection. There is no prayer with regard to the alleged excess rate being charged by the KMDA.
The petitioner is already enjoying electricity at the locale. New electric supply cannot be afforded to the petitioner at a premise which is being occupied by HighTension supply. There being no prayer with regard to the so-called excess charge made by the KMDA, no relief can be granted to the petitioner.
In such circumstances, I find no merit in the present writ petition.
WPA 8025 of 2020 is dismissed accordingly.
