rkd 06.10.2020 Ct. No.12 C.R.M. 7615 of 2020 (IA NO: CRAN 1/2020) (Through Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed in connection with Mothabari P.S. Case No. 229 of 2020 dated 24/06/2020 under Sections 302/34 of the Indian Penal Code.
And In the matter of: - Dijen Mandal & Ors.
....petitioners.
Mr. J. Hossain ...for the petitioners.
Mr. S. Ghosh, Mr. B. Banerjee ...for the State.
Petitioners undertake to affirm and stamp the petition/application as per Rules within a month of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference. Accordingly, the application being CRAN 1 of 2020 is disposed of.
It is submitted on behalf of the petitioners that there was dispute over landed property and they have been falsely implicated in the instant case.
Learned counsel appearing on behalf of the State opposes the prayer for bail.
We have considered the materials on record including the statement of eyewitnesses disclosing the role of the petitioners in assaulting the victim mercilessly resulting in his death. In view of the aforesaid facts and the gravity of the offence, we are not
inclined to grant bail to the petitioners at this stage. The application for bail is, thus, rejected.
