Narayan Chandra Maity v. Manish Jain
15.01.2021 SL No.17 wt 18 Court No.12 (gc) CPAN 502 of 2020 Sri Narayan Chandra Maity Vs.
Sri Manish Jain In FMA 374 of 2010 (Via Video Conference) Mr. Uttam Kr. Bhattacharyya, ...for the Petitioner.
Mr. Joytosh Majumdar, Ld. G.P., Mr. Raja Saha, Mr. Biswabrata Basu Mallick, ...for the Alleged Contemnor.
The learned Government Pleader representing the alleged contemnor has produced before us few documents to show that the order, alleged to have been violated, has been complied with within the time prescribed by the order. It appears that on 19th February, 2020, an order was passed by the alleged contemnor and it was forwarded to the writ petitioner by speed-post with acknowledgement due on 19th February, 2020. However, the learned Counsel for the writ petitioner submits that his client has not received any such communication. Be that as it may in view of the fact that an order has been passed on 19th February, 2020 and apparently it appears that it was sent by speed-post on 20th February, 2020.
A Photostat copy of the order dated 19th February, 2020 be kept with the record.
We dispose of this contempt application by recording compliance.
We make it clear that we have not gone into the merits of the order passed by the alleged contemnor. (Saugata Bhattacharyya, J.) (Soumen Sen, J.)
