.... For opposite parties Mr. Kar, learned senior advocate appears on behalf of opposite parties but none appears in support of the petition made under article 227 of Constitution of India. Mr. Kar submits, petitioners are plaintiffs. The have impugned order no.4 dated 18th September, 2020 passed by District Judge, South 24 Parganas in Misc. Appeal 83 of 2020 (Jaidip Mukerjea vs. Indradeep Mitra & Anr.). He demonstrates from impugned order that there were directions for holding extra-ordinary general meeting. He submits, the meeting has since been held on 11th October, 2020, which is why petitioners have lost interest. Order sheet reveals petitioners had obtained order on 8th October, 2020 for urgent listing on 9th October, 2020. Since the meeting has been held on 11th October, 2020, it is therefore presumed that petitioners have lost interest. The petition is dismissed as not pressed.
