Bari, learned Counsel appearing for the petitioner submits that the petitioner has made a representation being annexure P3 to the writ petition at page and prays for consideration of such representation by the Commissioner of School Education, (Primary Branch) at an earliest.

Mrs. Bhattacharya, learned Counsel appearing for the State submits that such representation can only be considered by the Secretary, Higher Education Department.

Heard both the parties.

The Secretary, Higher Education Department being the respondent no. 1 is requested to consider the representation being annexure P3 to the writ petition at page 19 within a period of three months from date after giving an opportunity of hearing and to allow the

petitioner to produce necessary documents at the time of hearing. The Secretary, Higher Education Department being the respondent no. 1 is also requested to communicate such decision arrived at by him at an earliest.

With the above direction, WPA 8106 of 2020 is disposed of.

Since no affidavits have been invited, the allegations contained in the writ petition are deemed not to have been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on the usual undertakings.
