I directed the Secretary to appear personally before this court and appearing before this court, she explained that there were some mistakes in respect of compliance of the above mentioned order of this court.

Hence I set aside the order passed by the Secretary of West Bengal Board of Primary

Education dated 2.9.2020 and direct the appropriate authority to take appropriate decision following the judgment and order passed by this court on 13th August, 2020 in W.P. no. 5747 (W) of 2020.

Learned Advocate for the Respondent nos. 2 and 3 has submitted that the appropriate authority of this matter is the Commissioner of School Education. Hence the Commissioner of School Education being Respondent no. 4 will consider the matter following the order passed by this court on 13th August, 2020 within a period of two months from the date of communication of this order. With this direction, this writ application is disposed of.
