19. 10 . 2020 CRM 7711 of 2020 (Via Video Conference) BP Sl. 8 In re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973 in connection with Chanditala Police Station Case No. 269 of 2019 dated 25.06.2019 under Sections 302/34 of the Indian Penal Code.

The petitioner undertakes to appropriately stamp the petition as per the Rules within one month of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

Learned advocate for the petitioner submits that the petitioner has been falsely implicated in the present case. He is innocent one. He also draws court's attention to the post mortem report.

Learned advocate for the State opposes the prayer for bail and produces the case diary and also draws the

attention of this court to the statement of the eye witness recorded under Section 164 of the Cr.P.C.

Considering the materials in the case diary and perusing the record, in our considered view, the petitioner should not be granted bail at this stage.

Accordingly, the prayer for bail is rejected. The application for bail being CRM 7711 of 2020 is disposed of.
