Mr. Prabir Majumdar, Advocate ...for the Petitioner Mr. Binay Panda, Advocate Ms. Puspita Saha, Advocate ...for the State COURT NO. 12 ITEM NO. 09 snandy (BAIL - ALLOWED) Petitioner undertakes to affirm and stamp the petition/ application as per Rules within one month of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference.

Having considered the materials on record as well as the materials available in the case diary disclosing that only 5 KGs of contraband was recovered from the possession of petitioner, which is below the commercial quantity, the application for bail of the petitioner is allowed. Accordingy, the petitioner, namely Neela Balmiki, shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of Rs.5,000/- each, one of whom must be local to the satisfaction of learned Chief Judicial Magistrate, Nadia, subject to the condition as enshrined under Section 437(3) of the Code of Criminal Procedure with further condition that the petitioner shall attend the trial on each day and shall not leave the jurisdiction of the Court without express leave of the trial Court. In the event, the petitioner fails to comply with the conditions as envisaged in this order, it is open to the trial Court to cancel the bail without making any reference to this Court.
