Subject to such undertaking the application is taken up for hearing.

It is submitted on behalf of the petitioner that the aforementioned case has been initiated out of a dispute in the village.

It is submitted that the petitioner was not involved in the offence complained of. It is further submitted that the victim had refused medical examination. Thus, the petitioner prays for grant of anticipatory bail.

It is submitted on behalf of the learned Advocate for the State that this is not a fit case for granting anticipatory bail and relies upon the case diary.

In view of the statement of the victim under Section 164 Cr.P.C. and upon considering the materials on record we do not think that this is a fit case for grant of anticipatory bail.
