The petitioner submits that he is occupying an agricultural land. The private respondents are making illegal construction in the said land.

The petitioner approached the police authority by filing a general diary on 5th September, 2020. The Sub-Divisional Officer by communication dated 15th September, 2020 made to the Sub-Divisional Police Officer of Kakdwip directed the Officer-in-Charge of the Pathar Pratima Police Station to ensure that there should be no breach of peace and tranquility in the locale. It was further mentioned that in view of the pandemic situation, the Pathar Pratima Police Station was looking after the area in question.

The concerned police station is directed to ensure that there is no breach of peace and tranquility in the locale.

The petitioner shall be at liberty to approach the appropriate forum, in accordance with law, for any restraining orders to be passed against the private respondents in respect of the alleged illegal construction made by them in his agricultural land. W.P.A. 8228 of 2020 is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
