...for the alleged contemnors Director of Pension, Provident Fund and Group Insurance, Government of West Bengal, has filed an affidavit affirmed on 22nd April, 2022, inter alia stating the following: "That a Pension bill No. 82 dated 13.04.2022 containing the amount of Rs.4148224/- (Forty One Lakh Forty Thousand Two Hundred Twenty Four Only) was issued to the applicant Raj Kumar Jana by the Haldia Treasure for the period from 19.09.2019 to 31.03.2022 in compliance with the order passed by Hon'ble Division Bench on 27.11.2019 in connection with the MAT no. 398 of 2018."

Mr. Golam Mastafa, learned Counsel appearing on behalf of the petitioner has admitted that his client has received the said amount. However, it is submitted that the pension amount has not yet been fixed.

Mr. Tapan Kumar Mukherjee, learned Additional Government Pleader has submitted that in terms of the order dated 27th November, 2019, re-fixation has to be done for which the

second PPO would be issued shortly. In fact, the petitioner would be receiving pension much less then what he has received earlier because of the excess payment.

In view of the aforesaid, we find that the Director of Pension, Provident Fund & Group Insurance, has complied with our order dated 27th November, 2019.

Belated compliance with apology is accepted. The contempt petition being CPAN 511 of 2020 is disposed. Personal appearance of the Director of Pension, Provident Fund and Group Insurance is dispensed with.
